Your Rights – You Can Demand:

When You Require Police Assistance

In case of any emergency, we are at your immediate service. When you contact us, we will answer your call immediately (30 seconds).
If you are a victim of crime, or see anybody committing a crime please DIAL 100 or contact your nearest police station or Patrol Vehicle (PCR).
If you are aware of a crime about to be committed, and want to pass on information anonymously, we promise to keep the source of the information confidential.
If you are a woman, and require immediate redressal, please DIAL 100/1091 to reach Women Helpline or contact Women Helpdesk of the nearest Police Station.
If you are visiting Andamans for tourism, and in need of urgent police assistance, please DIAL 100 for Tourist Assistance or contact police personnel/patrol vehicle nearby.

When You Visit the Police Station to Report An Incident

We will be helpful & polite;
We will deal promptly and positively with your complaint;
We will tell you how long it will/take before an officer attends to your problem and explain reasons for delay, if any.

When You Want to Report a Crime:

If you are a victim of a crime or a witness to a crime or have knowledge about a crime you have the right and duty to report it to the police;
We will record complaints irrespective of the place or jurisdiction;
We will register an FIR, in accordance with the information given by you, and give you a copy free of cost.
We will carry out a timely, professional, independent and impartial investigation into every crime reported to us;
We will not summon any child below 18 years of age, senior citizens and women or sick patients to a police station;
We will dispose simple cases within 45 days and heinous cases within 90 days positively. And, if there is a need to carry out further investigation, beyond the stipulated time, the same will be informed to the complainant;
We will keep you updated on the progress of your complaint, at reasonable intervals. SHO/Investigating Officer will provide you the progress of the case any day between 3 PM – 6 PM.
We will help victims in claiming deposited property/articles from court, after the trial is completed or property is not required.

When You Are a Victim of Sexual Assault:

We understand the sensitive nature of such complaints and will make sure that such cases are dealt with utmost sensitivity and courtesy. Extra care and consideration is given to victims of sexual assault;
Every such victim will be dealt with a female police officer, preferably;
The offence will be registered immediately without any delay;
A medical examination will be conducted by a registered female medical practitioner with strict regard to decency and concern for the mental and physical condition of the victim.

When You Are a Victim of Domestic Violence:

You can contact Women Helpline 1091/100, for immediate assistance;
You can contact Women Helpdesk established at every Police Station or Women Cell in Port Blair, for long term counselling and assistance. In case of counselling, if in house facilities are not available, you will be referred to a professional counselor. In case of legal aid, we will refer you to the concerned Legal Services Authority, if you so desire.
If there is an infringement of a restriction order imposed under the Domestic Violence Act, we will take action under the law.

When You Are Arrested:

We will reach the place of a traffic accident, immediately on being informed.
We will help the injured person secure First Aid and medical assistance;
We will provide copies of documents free of cost, for claiming insurance within 7 days.
We will ordinarily complete investigation of a traffic accident case within 30 days.
When you are caught for violation of a traffic rule, which can be compounded, you will be provided with the option of to compound on the spot or contest it in the Court.
In case, the offence is not compoundable by the police, like Drunken Driving, you will be dealt with in accordance with the relevant provisions of the Motor Vehicle Act, including arrest, medical examination, etc.
We undertake traffic regulation at main points where traffic congestion or heavy traffic movement is observed;

When You Are in Need of Rescue/Relief during a disaster situation:

In case of out break of fire or floods, we will organize Rescue and Relief operations immediately;
We will work closely with Fire/Health and other Departments and organize ambulances, medical aid, food for the affected people.

When You Organize Large Gatherings of People:

We assist and regulate crowds during fairs, festivals, public functions by making bandobast, provided you have requisite permission, NOC from authorities concerned.

When You Approach the Police in a Complaint:

We do not undertake to resolve civil disputes, recover money owned, or anything that finds a remedy under ordinary civil law.
We undertake enquiry as part of the power entrusted to us U/S 149 Code of Criminal Procedure, in order to prevent the commission of cognizable offences;

When You Are Apprehended (Arrested) by Police in a Crime:

In case of your arrest by any police officer you have a right to know the reason of your arrest and to receive a copy of the Arrest Memo prepared by the arresting police officer. Arrest Memo will bear your signature and signatures of your relative, friend in any other districts, then by telephone or through local Legal Aid Cell.
After arrest, a record of your arrival/departure shall be entered in General Diary of the concerned police stations/out post. You have a right to inform your friend/relatives/lawyer who has interest in your welfare immediately after your arrest. If the person stays in other district, then you can inform by telephone or through local Legal Aid Cell.
The arrestee has a right to meet his lawyer during the investigation.
In regard to Search or personal search after your arrest, you have a right to ask a copy of the Search Memo from the officer conducting Search or the IO. The items seized are to be mentioned in the Seizure Memo, prepared in the presence of two local independent witnesses with their signatures on it. You have a right to keep a copy of such a Seizure Memo.
After arrest, you also have a right for Medical Examination by a govt. Doctor immediately and later/after every 48 hours of your custody in police.

When You Need Licenses, Permits, Verifications and Certificates:

  • Last five-year residential proof (self-declaration).

Duties of and Expectations from Citizens:

Every person is bound to assist a police officer reasonably demanding his aid in taking or preventing the escape of any person who could be lawfully arrested; in preventing or controlling breach of peace; and to prevent damage to public property. (Sec. 37 CrPC)

Any person aware of the commission of certain serious offence or intention thereof, is duty bound to give information to the nearest police officer of such a commission or intention (Sec. 37 Cr.PC). These IPC crimes include offences -

  1. Take initiative to check the crime. A private citizen can Arrest or cause a person to be arrested if any Non-Bailable and Cognizable offence is committed in his presence or a Proclaimed Offender comes across them. (Sec 43 Cr.PC)
  2. Protect public property and do not indulge in acts, that damage or deface public property or places.
  3. All road users must be guided by the objective of enhancing Road Safety and must pay heed to the legitimate directions and suggestions of traffic police personnel and observe traffic Norms and Regulations.
  4. Help injured persons in Road Traffic Accidents by taking them to nearby hospitals and by informing the police. If desired, one would not be asked to be a witness in the case or otherwise put to any inconvenience.
  5. Community Policing initiatives must be given whole-hearted support. Security particularly to curb crimes like thefts and burglaries can be greatly enhanced if the local community takes initiative to improve the physical security arrangement of the neighbourhood and individual houses/establishments and deploys an adequate number of watchmen.

Omission to give such information or giving false information by any person shall be liable for punishment under Section 176 and 177 IPC respectively.

And, finally it shall always remain our Motto to serve the public to the best of our abilities and we expect all cooperation from the public in achieving this goal.

Rights of Victims/Complainants of Crime:

Every person is bound to assist a police officer reasonably demanding his aid in taking or preventing the escape of any person who could be lawfully arrested; in preventing or controlling breach of peace; and to prevent damage to public property. (Sec. 37 CrPC)

Whenever any Cognizable offence (where a police officer can arrest the offender without warrant) is committed,

  1. The aggrieved person or any other person can file an FIR orally or in writing with the Officer-in-charge of a police station.
  2. In case of refusal to register a Cognizable offence, the complainant can send his complaint by post to the Superintendent of Police who can start the process of Investigation.
  3. A copy of the FIR is given free of cost to the informant.
  4. After registration of FIR, investigation is taken up.
  5. Thereafter, findings are sent to the Court under Section 173 Cr.PC and the complainant is duly informed.
  6. When adequate evidence comes on record, the case is sent for trial.
  7. When evidence is inadequate, the case is sent as untraced.
  8. When it is found that no offence was committed, the case is sent for cancellation.
  9. Where a case is sent as untraced or cancelled, the informant can represent his case before the Court, who hears the person before accepting the police report.
  10. Section 167(1) Cr.PC prescribes that every investigation shall be completed without unnecessary delay though no time limit is fixed for completion of investigation.
  11. A complainant or a victim, in case of a grievance that investigation has not been proper or speedy, can represent to the superior officers who can issue appropriate directions including further investigation.
  12. If a person is unable to go to a police station to lodge his complaint, he can send it by post.
  13. People can also inform about commission of a Cognizable offence or its likelihood to the Police Control Room at telephone number 100, a round the clock toll free number. Systems exist to immediately depute local police officers and PCR vehicles to the spot to take appropriate legal action.
